Navigator Beach Club timeshare never materialized.

Folks should file a complaint whith the Massachusetts Attorney General.

Then File a complaint with the Cape Cod Consumer Affairs Office.

Then file a complaint with  Det. Sgt Ben Wunderlich at the Dennis PD.

Then register as a member so you can post in the forums.

  Navigator Beach Club Cape Cod Update from Dennisport Police (From the forums)

The criminal investigation against Mr. Reposa is now on hold per request of State Attorney General. The local District Attorney will now go over the case as it becomes a civil case instead of a criminal case. The local DA wants to talk to Mr. Reposa and his attorney to see if a deal can be reached. The criminal case has not gone away as Mr. Reposa has collected closing costs from us which include filing deeds which was not done. DA office feels there is still a chance of the criminal case continuing as there is a chance of criminal wrong doing with the lack deed filing.

I asked if the class action suit that a few of us were involved in should be stopped and the answer was NO. Don't stop as it can always be dropped later. The class action civil suit is for Mr Reposa returning our funds whereas the civil suit from the DA's Office is for fraud. There is only a certain amount of time to file a civil suit to get our funds returned. (his ability to pay diminishes over time as he presently has federal, state, and contractor debt).

VERY IMPORTANT - The second bid at the auction HAS GONE THRU and the new owner is taking over the property. It is unclear if the new owner will finish the timeshare or finish it off as a hotel. It is NOT the new owner's responsibility to take care of us. He has purchased the building and land.
The Local DA's Office wants to question Mr. Reposa as to why the Navigator is in the state it is, where is the money that was collected and where did it go. There is NO guarantee with either the authorities civil or criminal case that we will get our money back. The AG's civil suit does not guarantee we will get back our funds but that some agreement might be reached.
The State AG's civil suit will take 1 YEAR to complete and the AG's Office is NOT returning calls from the Dennisport Police.

Message: I  contacted the attorney generals office hoping to get some information. They said they have no information to give us. They said that they have only received 139 written complaints as of 6/27/08. If there is anyone reading this that hasn't filed one please submit a complaint form. The more they get the better off we will be. I spoke to george fintonis today his company is taking care of the issues that the 20 people who purchased navigator timeshares through ocean view resorts had. I'm hoping that the attorney generals office hasn't put us on the back burner I know they are busy, but there is alot of money involved here ,and alot of people are getting burnt. Not to mention that some of the people that were taken are elderly. I thought there were laws in Massachusettes protecting the elderly. If we don't get results shouldn't someone go to jail, or has someone got connections.
